- Ongoing maintenance and support (where agreed)
2.2 Service Agreement
Specific project details, scope, timeline, and pricing will be outlined in a separate proposal or contract agreed upon by both parties before work commences. These Terms supplement but do not replace any project-specific agreements.
3. Use of the Website
3.1 Acceptable Use
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by any third party.
3.2 Prohibited Activities
You may not:
- Use the Site to transmit harmful, threatening, abusive, or defamatory content
- Attempt to gain unauthorized access to any part of the Site, server, or network

- Portfolio Rights: Unless otherwise agreed in writing, we reserve the right to display completed projects in our portfolio, case studies, and marketing materials.
- Code & Tools: Any custom code, frameworks, or proprietary tools developed by us remain our intellectual property, but the client receives a license to use them as part of their website.
5. Payment Terms
5.1 Pricing
Project pricing will be outlined in the project proposal or contract. Prices are subject to change based on scope adjustments or additional requests outside the original agreement.
5.2 Payment Schedule
Unless otherwise agreed:
- A deposit (typically 30-50%) is required before work begins.
- The remaining balance is due upon project completion or according to milestones outlined in the project agreement.
- Retainer services are billed monthly in advance.
5.3 Late Payments
Invoices not paid within 14 days of the due date may incur late fees and suspension of services until payment is received.
5.4 Refunds
Deposits are non-refundable once work has commenced. Refunds for completed work are not provided unless otherwise agreed in writing.
6. Project Timeline & Delays
6.1 Timelines
Project timelines are estimates and subject to change based on client feedback, content delivery, and unforeseen technical issues. We will communicate any delays promptly.
6.2 Client Responsibilities
Timely delivery of projects depends on the client providing:
- Required content (text, images, branding materials)
- Timely feedback on designs and progress updates
- Access to necessary accounts (hosting, domain, WordPress admin, etc.)
Delays caused by the client may extend the project timeline accordingly.
7. Revisions & Scope Changes
7.1 Included Revisions
Each project includes a specified number of revision rounds as outlined in the project proposal. Additional revisions beyond the agreed scope may incur extra charges.
7.2 Scope Creep
Requests that significantly expand the project scope beyond the original agreement will require a revised proposal and additional payment.
8. Website Maintenance & Support
8.1 Post-Launch Support
All projects include 15-30 days of post-launch support (as specified in the project agreement) to address bugs, minor adjustments, and technical issues directly related to the delivered work.
8.2 Ongoing Maintenance
Ongoing maintenance, updates, and feature additions after the support period require a separate maintenance agreement or are billed hourly/monthly as agreed.
8.3 Third-Party Issues
We are not responsible for issues caused by third-party plugins, hosting providers, theme updates, or client modifications made after project delivery.
9. Warranties & Disclaimers
9.1 Service Warranty
We warrant that all services will be performed with reasonable skill and care in accordance with industry standards. However, we do not guarantee specific results, rankings, traffic, or revenue outcomes.
9.2 Third-Party Tools
We may use third-party plugins, themes, APIs, and hosting services. We are not responsible for the performance, security, or availability of third-party services beyond our control.
9.3 Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Our total liability for any claims arising out of these Terms or our services shall not exceed the total amount paid by the client for the specific project in question.
11. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the project. This includes business strategies, code, designs, login credentials, and other sensitive data.
12. Termination
12.1 By Client
The client may terminate the project at any time by providing written notice. In such cases:
- Payment is due for all work completed up to the termination date.
- Deposits are non-refundable.
- Any deliverables completed will be provided to the client.
12.2 By Reshetar.Dev
We reserve the right to terminate a project if:
- Payment is not received as agreed.
- The client engages in abusive, threatening, or unethical behavior.
- The client fails to provide necessary materials or feedback within a reasonable timeframe.
13. Indemnification
You agree to indemnify and hold harmless Reshetar.Dev from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Site or services
- Your violation of these Terms
- Content you provide (text, images, logos) that infringes third-party rights
14. Governing Law & Dispute Resolution
